Beware of False Debt Review Removal Promises

Garden Route Debt Counsellors in Hartenbos and Mossel Bay warns consumers under debt review to beware of false debt review removal promises by companies or individuals. The National Credit Regulator (NCR) has received several complaints from consumers under debt review who were approached by companies or individuals offering to remove their debt review status for a large fee. These promises often turns out to be false and also in most cases the debt review status is not removed as claimed. This practice is in direct violation of the National Credit Act (NCA).
While consumers do have the right to be removed from debt review, this process must follow strict guidelines set out in the NCA. The only lawful way to exit debt review is in accordance with Section 71 of the National Credit Act (NCA). This process requires the issuance of a Clearance Certificate, also known as a Form 19, by a registered debt counsellor. This certificate can only be issued once all the substantive and procedural requirements of the NCA have been met.
Any company or individual offering unlawful debt review removal services is in contravention of Section 126A(3) of the NCA. They are required to comply with these legal provisions or cease such services immediately. Failure to do so may result in enforcement action by the NCR.
